James joined Setfords as Head of Litigation from a leading London and South East based practice.

James has a robust, commercial and results orientated approach to cases. Primarily acting for regional SME’s and private individuals, James also often acts for national PLCs as part of a larger project team.

James preference is to attend upon his commercial clients at their place of business to facilitate an understanding of their business and operational model.   Taking the time to do this enables James to provide contextual advice more akin to that which typically is only available from an in-house General Counsel.

Commercial Work:

As regards contentious work James is principally instructed in commercial contract disputes, professional negligence (legal/accountancy) and employment matters in the County Court, High Court and Employment Tribunal. James non-contentious commercial work primarily consists of contract based work matters including;

  • General contract advisory including , review and drafting
  • Generalist employment matters supporting an internal HR function
  • Due diligence during acquisitions
  • Advising upon TUPE Regulations relating to business transfers or acquisitions
  • Distribution agreements and commercial arrangements

James often advises on an ad-hoc basis for his commercial clients on a variety of issues, often initially as a sounding board for the routine concerns  which arise in the course of business where timely contextual legal advice is of substantial benefit.

Private Client / Individuals:

James’ private client practice is a generalist civil litigation and employment advisory practice which has a significant overlap with his core commercial practice areas. Typical client instructions include advising upon and negotiating executive termination packages (Settlement Agreements), debt / loan recovery, residential property disputes  including ownership / equitable interest cases.

Specialist Area – Equine Law:

In addition to his generalist Civil Litigation practice James has a particular interest in Equine Law on account of an extensive personal background in this area. James’ interest in equine law extends to commercial clients whose business is connected with the equine world either directly or in a peripheral manner.
